These Terms and Conditions (these “Terms”), together with our Privacy Policy, Bidder Terms, Seller Terms, Cookies Policy, and any other policies referenced herein, govern your access to and use of SellComputerParts.com (“Sell Computer Parts”), including the website, marketplace, features, tools and services that we now provide or may provide in the future (collectively, the “Services”).
The Services are provided by Sell Computer Parts (“Sell Computer Parts,” “we,” “our,” or “us”). “You” and “your” refer to any person or entity accessing or using the Services, including visitors, Buyers, Bidders and Sellers.
THESE TERMS CONSTITUTE A BINDING AGREEMENT BETWEEN YOU AND SELL COMPUTER PARTS. PLEASE READ THEM CAREFULLY. BY ACCESSING, REGISTERING FOR, OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO BE BOUND BY THESE TERMS.
1. Marketplace Services
Sell Computer Parts operates an online marketplace that allows independent Buyers and Sellers to connect for the potential purchase and sale of new, used, refurbished and pre-owned computer parts, computer components, computers, electronics, networking equipment, peripherals, accessories and other approved computer-related products (“Listed Items”).
Listed Items may include, without limitation, graphics cards (GPUs), processors (CPUs), motherboards, memory (RAM), solid-state drives, NVMe drives, hard drives, storage devices, power supplies, computer cases, cooling systems, fans, expansion cards, networking equipment, monitors, keyboards, mice, peripherals, desktop computers, gaming PCs, workstations, laptops, servers, computer accessories, component bundles and other approved computer hardware.
Sell Computer Parts is not the Buyer or Seller of Listed Items and, unless explicitly stated otherwise, does not take possession of, inspect, test, authenticate, refurbish, warehouse, package, ship or deliver Listed Items.
Buyers and Sellers enter into transactions directly with one another. Sell Computer Parts is not a party to the purchase agreement between a Buyer and Seller.
Sellers are solely responsible for the Listed Items they offer, including the accuracy of descriptions, photographs, specifications, model numbers, serial numbers, condition, functionality, compatibility information, ownership, authenticity, legality, shipping, warranties, return policies and all other representations made in a listing.
Buyers are responsible for carefully reviewing listings and determining whether a Listed Item is appropriate and compatible with their intended use before completing a transaction.
We may monitor or review marketplace activity, communications, listings and disputes when we believe it is appropriate to protect users, enforce these Terms, prevent fraud, comply with applicable law or protect the integrity of Sell Computer Parts.
2. Eligibility and Use of the Services
You may use the Services only if you are legally capable of entering into a binding contract and your use of the Services complies with all applicable federal, state, local and international laws and regulations.
You must be at least the age of majority in your jurisdiction to buy, sell, bid or otherwise enter into transactions through Sell Computer Parts.
Our Services are not available to users whose accounts have previously been permanently suspended or terminated unless Sell Computer Parts expressly authorizes the creation of another account.
We reserve the right to restrict, suspend or terminate access to the Services when we reasonably believe such action is necessary to prevent fraud, protect users, protect Sell Computer Parts, comply with applicable law or address violations of these Terms.
3. User Accounts
A registered account may be required to buy, sell, bid, make offers, create listings or use certain marketplace features.
By creating or using an account, you agree that you will:
- Provide accurate, current and complete information.
- Keep your account information reasonably current.
- Maintain only accounts that you are authorized to use.
- Keep your password and account credentials confidential.
- Not impersonate another individual, company or organization.
- Not provide false, fraudulent, deceptive or misleading information.
- Not use your account for unlawful or fraudulent activity.
- Promptly notify us if you believe your account has been compromised.
You are responsible for activity conducted through your account unless prohibited by applicable law.
Accounts may not be sold, assigned or transferred to another party without our prior written authorization.
If you create or use an account on behalf of a company, organization or other legal entity, you represent that you have authority to bind that entity to these Terms.
We may request information reasonably necessary to verify your identity, business, account or eligibility to use certain marketplace features.
4. Seller Requirements
Sellers are responsible for complying with all laws, regulations, third-party rights and applicable marketplace requirements relating to their listings and transactions.
By creating a listing, a Seller represents and warrants that:
- The Seller owns the Listed Item or has legal authority to sell or transfer it.
- The Listed Item is lawful to sell or transfer.
- The listing accurately describes the Listed Item.
- All photographs and information used in the listing may lawfully be used by the Seller.
- The Listed Item is not stolen, counterfeit or fraudulently represented.
- The Seller will disclose known material defects, damage, missing components, modifications or limitations.
- The Seller has the ability to deliver the Listed Item as represented.
- The Seller will honor a successfully completed sale in accordance with these Terms.
- The Seller will comply with the shipping, delivery, payment and other terms stated in the listing.
- The Seller will pay all applicable Sell Computer Parts fees.
Additional requirements applicable to Sellers are contained in our Seller Terms.
5. Seller Credit Card Requirement
To create listings or sell through Sell Computer Parts, Sellers may be required to maintain a valid credit card, debit card or other approved payment method on file.
Payment information may be processed and securely stored by our third-party payment processor, including Stripe. Sell Computer Parts does not require access to your complete card number in order to charge authorized marketplace fees.
By adding a payment method to your Seller account, you authorize Sell Computer Parts and its payment processor to charge that payment method for amounts properly due under these Terms, including:
- Seller Service Fees
- Optional listing upgrades
- Optional promotional services
- Store or subscription fees, if applicable
- Other fees that you specifically authorize
You are responsible for maintaining a valid payment method while you have outstanding listings, transactions or marketplace fees.
If an authorized charge is declined, reversed or otherwise cannot be collected, we may restrict your ability to create additional listings, suspend your Seller privileges or take reasonable steps to collect the amount due.
6. Marketplace Fees
Unless otherwise stated on our Site Fees page, Sell Computer Parts does not charge a standard fee merely to create a basic listing.
When a Listed Item successfully sells, the Seller is charged a 6% Seller Service Fee based on the final item sale price, unless a different fee was clearly disclosed to the Seller before the listing or transaction.
The Seller Service Fee may apply to sales completed through:
- Live Online Auctions
- Buy Now listings
- Accepted Make Offer transactions
Optional listing upgrades, promotional features, Featured Stores or other premium Services may carry additional charges. Any applicable charge will be disclosed before the Seller purchases or activates the optional Service.
Fees are subject to change. Changes will apply prospectively as disclosed through the website or Services.
7. Listings
Sellers are responsible for creating complete and accurate listings. Listings should include sufficient information for a reasonable Buyer to evaluate the Listed Item.
Depending on available marketplace features and the applicable category, Sellers may offer Listed Items through:
- 24-Hour Flash Auctions
- 7-Day Auctions
- Buy Now listings
- Make Offer listings
- Other listing formats that Sell Computer Parts may make available
Sellers must place Listed Items in appropriate categories and accurately describe material characteristics such as manufacturer, brand, model, part number, serial number when appropriate, specifications, condition, functionality, compatibility, storage capacity, processor type, graphics processor, memory capacity, form factor, included accessories and quantity when applicable.
Sell Computer Parts may remove, edit, restrict, hide or re-categorize a listing if we reasonably believe it violates these Terms, applicable law or marketplace policies, creates risk to users, is misleading or is inappropriate for the marketplace.
8. Computer Hardware Condition
Computer parts, electronics and complete systems may vary substantially in condition, functionality, performance and remaining useful life.
Sellers are responsible for accurately describing whether a Listed Item is:
- New
- Open Box
- Used
- Refurbished
- For Parts or Repair
- Untested
- Otherwise limited in functionality
Sellers must disclose known material defects or damage, including when applicable physical damage, bent pins, damaged connectors, missing components, liquid damage, overheating, unusual operating behavior, malfunctioning ports, fan issues, battery degradation, display defects or other conditions that could materially affect the value or operation of the Listed Item.
An item described as “untested” should not be represented as fully functional unless the Seller has a reasonable basis for making that representation.
An item listed “for parts or repair” should be presumed by the Buyer to require repair or to contain defects unless the Seller specifically states otherwise.
9. Compatibility and Performance
Computer components can require specific hardware, firmware, software, physical dimensions, interfaces, power requirements or other specifications to operate properly.
Buyers are solely responsible for determining compatibility with their existing or planned computer system before purchasing a Listed Item.
Compatibility considerations may include, without limitation:
- Processor socket
- Motherboard chipset
- Memory type and speed
- PCI Express generation and slot requirements
- Power supply capacity and connectors
- Case dimensions and component clearance
- Cooling requirements
- Storage interfaces
- Operating system compatibility
- Drivers
- Firmware or BIOS requirements
- Networking standards
- Peripheral connections
Sell Computer Parts does not guarantee compatibility, benchmark performance, overclocking capability, remaining product life, manufacturer warranty, driver support, firmware support or suitability of any Listed Item for a particular purpose.
10. Overclocking, Mining and Modified Hardware
Sellers should disclose known material modifications or usage history that could reasonably affect a Buyer’s purchasing decision.
This may include, when known and material, hardware that has been modified, repaired, overclocked, flashed with modified firmware, used for cryptocurrency mining, operated outside manufacturer specifications or otherwise altered from its original configuration.
Sellers may not knowingly misrepresent modified, repaired or heavily used hardware as new or materially misrepresent its condition or usage history.
Sell Computer Parts does not independently verify the historical usage, operating temperatures, workloads, clock speeds or prior modifications of Listed Items.
11. Storage Devices and User Data
Sellers offering hard drives, solid-state drives, NVMe drives, computers, servers, mobile devices or other products capable of storing information are responsible for removing personal, confidential, proprietary or sensitive data before shipment or transfer.
Sellers should securely erase storage devices before selling them when appropriate.
Buyers should not assume that a used storage device has been securely erased, is free from recoverable data or is free from malicious software.
Buyers are encouraged to properly erase, format and inspect used storage devices before placing them into service.
SELL COMPUTER PARTS IS NOT RESPONSIBLE FOR DATA REMAINING ON, RECOVERED FROM, LOST FROM OR STORED ON ANY LISTED ITEM.
12. Device Locks, Passwords and Firmware
Sellers are responsible for removing passwords, administrative restrictions, account locks, activation locks, BIOS passwords, firmware restrictions or other access controls that would prevent a Buyer from reasonably using a Listed Item as represented.
If a Listed Item contains a known restriction or lock that cannot or will not be removed before the sale, the Seller must clearly disclose that condition in the listing.
Sellers may not knowingly sell devices that remain unlawfully connected to another person’s account, organization or management system.
Sell Computer Parts does not guarantee that a Buyer will be able to reset, unlock, update, register or activate any Listed Item with a manufacturer or third-party service.
13. Auctions and Bidding
When you place a bid in an auction, you are making a commitment to purchase the Listed Item if you are the winning Bidder, subject to any reserve price or other conditions clearly stated in the listing.
Bids generally may not be withdrawn solely because a Buyer changes their mind, makes an error concerning the item’s value or later finds another item at a lower price.
Sellers agree to honor completed auctions in which the applicable selling requirements have been satisfied.
Sell Computer Parts may use automatic bidding, proxy bidding or other bidding features as described within the applicable auction.
Anti-Sniping Protection: If a qualifying bid is placed during the final two (2) minutes of an auction, the auction may automatically extend so that approximately two (2) minutes remain for additional bidding. Additional qualifying bids may result in further extensions.
Sell Computer Parts may cancel, suspend, extend or otherwise correct an auction when reasonably necessary because of technical errors, fraud, listing errors, system outages or violations of these Terms.
Additional requirements applicable to auction participants are contained in our Bidder Terms.
14. Reserve Prices
Certain auctions may permit a Seller to establish a reserve price.
If the highest valid bid does not satisfy the applicable reserve price, the Seller may not be obligated to sell the Listed Item unless the Seller voluntarily agrees otherwise.
15. Buy Now
A Buyer who completes a Buy Now purchase agrees to purchase the Listed Item at the displayed price and comply with the Seller’s disclosed payment, shipping, delivery and transaction terms.
16. Make Offer
Certain listings may allow Buyers to submit offers to Sellers.
An offer does not create a completed sale unless and until it is accepted by the Seller through the marketplace or otherwise becomes binding under the applicable marketplace workflow.
If a Seller accepts a Buyer’s offer, both parties agree to complete the transaction at the accepted price subject to the applicable listing terms.
17. Buyer Responsibilities
Before purchasing or bidding on a Listed Item, Buyers should:
- Carefully review the entire listing
- Review all applicable photographs
- Confirm model numbers and specifications
- Confirm hardware and software compatibility
- Review the stated condition
- Review known defects or limitations
- Review included and missing accessories
- Review shipping or delivery methods
- Review shipping costs
- Review the Seller’s accepted payment methods
- Review the Seller’s return or refund policy
- Ask the Seller questions when additional information is needed
A Buyer is responsible for paying for a Listed Item after entering into a binding purchase through an auction, Buy Now transaction or accepted offer.
18. Payment Between Buyers and Sellers
Unless expressly stated otherwise, payment for the purchase price of a Listed Item is made directly from the Buyer to the Seller using a payment method accepted by the Seller.
Available payment methods may vary by Seller and may include integrated or third-party payment providers or other payment arrangements permitted by Sell Computer Parts.
Sell Computer Parts is generally not the merchant of record for the Seller’s Listed Item and does not guarantee payments made directly between users.
Buyers and Sellers are responsible for reviewing the terms, fees, protections, limitations and dispute procedures associated with their chosen payment method.
Sell Computer Parts is not responsible for payment reversals, chargebacks, fraudulent payments, insufficient funds, payment processor decisions, account restrictions or other disputes arising from payment arrangements between Buyers, Sellers and third-party payment providers.
19. Shipping, Delivery and Local Pickup
Sellers are responsible for shipping Sold Items in accordance with their listing and any applicable agreement with the Buyer.
Sellers should appropriately package computer parts, computers, electronics, monitors, storage devices and other equipment to reduce the risk of damage during transportation.
Components that may be sensitive to electrostatic discharge should be packaged appropriately when reasonably necessary.
Fragile or high-value items should be packaged with reasonable protection considering the nature, size and value of the item.
When shipment tracking is available, Sellers are encouraged to provide tracking information to Buyers promptly.
Unless otherwise agreed between the Buyer and Seller, shipping, insurance, signature confirmation, delivery and local pickup arrangements are the responsibility of the parties to the transaction.
Sell Computer Parts is not responsible for items that are lost, stolen, delayed, misdelivered or damaged during shipment, delivery or local pickup.
20. Returns, Refunds and Cancellations
Because Sell Computer Parts does not own or sell the Listed Items, return and refund terms are generally established by the individual Seller, subject to applicable law.
Sellers are responsible for clearly disclosing their return or refund policy when applicable.
Buyers should review the Seller’s return or refund policy before placing a bid, making an offer or completing a Buy Now purchase.
A Buyer’s rights may also be affected by the policies of the payment service used for the transaction and applicable consumer protection laws.
Sell Computer Parts may assist users with communication regarding a dispute but is not required to issue refunds or reimburse users for transactions between Buyers and Sellers unless expressly required by law.
21. Transaction Circumvention
Users may not use Sell Computer Parts to identify or communicate with another user for the purpose of intentionally avoiding marketplace fees on a transaction initiated through or resulting from a listing on Sell Computer Parts.
Prohibited circumvention may include requesting that another user cancel a marketplace transaction and complete the same transaction privately solely to avoid applicable Sell Computer Parts fees.
Accounts engaging in intentional fee avoidance may be restricted, suspended or terminated, and applicable fees may remain due.
22. Prohibited and Restricted Items
Users may not list, sell, purchase or attempt to transact in products that are illegal, stolen, counterfeit, fraudulent or prohibited by Sell Computer Parts policies.
Prohibited listings include, without limitation:
- Stolen property
- Counterfeit computer components or electronics
- Items bearing unauthorized counterfeit trademarks
- Fraudulently modified or misrepresented hardware
- Items that the Seller does not own or have authority to sell
- Devices unlawfully locked to another person or organization
- Pirated or illegally distributed software
- Fraudulent software license keys or activation credentials
- Malware, spyware, ransomware or malicious computer programs
- Devices primarily intended for unlawful access to computer systems
- Products prohibited by applicable law
- Items obtained through fraud or other unlawful activity
- Other products Sell Computer Parts determines are inappropriate for the marketplace
We reserve the right to remove prohibited or questionable listings and restrict accounts associated with such activity.
23. Counterfeit, Stolen and Misrepresented Items
Sell Computer Parts prohibits knowingly listing counterfeit, stolen or fraudulently misrepresented products.
Sellers may not intentionally misrepresent material information including manufacturer, model number, serial number, processor specifications, graphics card specifications, memory capacity, storage capacity, component generation, product condition, functionality, ownership or authenticity.
Sellers may not knowingly alter identifying information or labels for the purpose of misleading Buyers regarding the identity, specifications, origin or authenticity of a Listed Item.
We may request additional information concerning a Listed Item and may remove listings or restrict accounts when we reasonably suspect fraud, counterfeiting, theft or material misrepresentation.
24. Serial Numbers and Product Identification
Sellers should provide accurate product identification information when reasonably necessary for a Buyer to evaluate a Listed Item.
Sell Computer Parts may request serial numbers, model numbers, part numbers, photographs, purchase information or other identifying information for fraud prevention, listing verification or dispute review.
Sellers may not knowingly alter, remove or misrepresent identifying information for the purpose of concealing theft, counterfeiting, fraud or the actual identity of a product.
25. User Communications and Conduct
Users must communicate with one another professionally and may not use the Services to threaten, harass, abuse, defraud, deceive, spam or otherwise harm another person.
Users may not:
- Send unsolicited commercial messages unrelated to marketplace transactions
- Attempt to obtain another user’s password or account credentials
- Request unnecessary account credentials or authentication information
- Send malicious links, files or software
- Impersonate Sell Computer Parts or another user
- Use marketplace communications to facilitate unlawful activity
- Harass or threaten Buyers, Sellers, employees or other users
26. Ratings, Reviews and Feedback
Sell Computer Parts may allow Buyers and Sellers to leave ratings, reviews or feedback regarding marketplace transactions.
Feedback must reflect the user’s genuine experience and may not contain fraudulent, defamatory, threatening, discriminatory, abusive or otherwise unlawful content.
Users may not manipulate the feedback system, create transactions solely to generate feedback, offer compensation for misleading positive feedback or threaten negative feedback for an improper purpose.
Sell Computer Parts may remove feedback that violates these Terms or our marketplace policies.
27. Intellectual Property Rights
Sell Computer Parts owns or licenses the intellectual property rights in the Services, including applicable website designs, software, trademarks, logos, graphics, marketplace functionality and original content.
Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, sell, license or commercially exploit our protected content without authorization.
Users must respect the intellectual property rights of Sell Computer Parts and third parties.
All third-party manufacturer names, product names, logos, trademarks and brands remain the property of their respective owners. Their appearance on Sell Computer Parts does not by itself imply affiliation, sponsorship or endorsement.
28. User Content
“User Content” includes listings, descriptions, photographs, videos, messages, reviews, comments, account information and other content submitted to the Services by users.
You retain any ownership rights you may have in your User Content. However, by submitting User Content to Sell Computer Parts, you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, display, distribute, modify and use such User Content as reasonably necessary to operate, improve, market and promote Sell Computer Parts and the Services.
You represent that you have the necessary rights to submit your User Content and that our permitted use of that content will not unlawfully infringe the rights of another party.
We may remove User Content that we reasonably believe violates these Terms, applicable law or marketplace policies.
SELL COMPUTER PARTS TAKES NO RESPONSIBILITY AND ASSUMES NO LIABILITY FOR USER CONTENT TO THE FULLEST EXTENT PERMITTED BY LAW.
29. Prohibited Uses of the Services
You may not:
- Use the Services for unlawful or fraudulent purposes.
- Attempt to gain unauthorized access to the Services or another user’s account.
- Interfere with or disrupt the operation or security of the Services.
- Introduce viruses, malware or other harmful code.
- Probe, scan or test the vulnerability of our systems without authorization.
- Circumvent access controls or security measures.
- Reverse engineer the Services except where expressly permitted by law.
- Use automated tools to scrape or extract marketplace information without our written permission.
- Use robots, spiders, crawlers or automated systems to collect marketplace content without authorization.
- Place an unreasonable or disproportionately large load on our systems.
- Copy or aggregate marketplace data for a competing service.
- Use Sell Computer Parts content to create or improve a competing marketplace without authorization.
- Misrepresent your identity or affiliation.
- Manipulate auctions, bids, offers, feedback or marketplace activity.
- Engage in shill bidding or artificial price manipulation.
- Attempt to obtain another user’s login credentials or authentication codes.
- Interfere with another user’s lawful use of the Services.
- Assist another person in engaging in prohibited activity.
30. Fraud and Marketplace Manipulation
Users may not manipulate marketplace pricing, bidding, offers, sales, feedback or other marketplace activity.
Prohibited activity includes bidding on your own Listed Items through another account, coordinating artificial bids, using related accounts to inflate prices, creating fake transactions, falsely claiming shipment or delivery or otherwise attempting to mislead other users about demand, pricing, ownership, condition, specifications, delivery or reputation.
We may cancel transactions, remove listings, restrict accounts or terminate users involved in suspected fraudulent or manipulative activity.
31. Manufacturer and Third-Party Services
Certain Listed Items may depend on independent manufacturers, software providers, warranty providers, operating systems, cloud services, drivers, firmware, licensing systems or other third-party services.
These third parties operate independently from Sell Computer Parts and may establish their own rules regarding warranties, product registration, software, drivers, firmware, updates, licenses, support and other services.
Sell Computer Parts does not control and is not responsible for the terms, policies, support decisions, warranty decisions, systems, availability or actions of independent manufacturers or service providers.
Users are responsible for determining whether any manufacturer warranty, software license, service plan or third-party benefit transfers with a Listed Item.
32. Manufacturer Warranties
A Seller may state that a Listed Item is believed to carry a remaining manufacturer warranty only when the Seller has a reasonable basis for that representation.
Unless expressly offered by the Seller, Sell Computer Parts does not provide any warranty for a Listed Item.
Manufacturer warranties may be non-transferable, limited to the original purchaser, restricted by region or conditioned on documentation or other requirements.
Buyers are responsible for independently verifying the availability and transferability of any manufacturer warranty that is important to their purchasing decision.
Sell Computer Parts does not guarantee that a manufacturer will honor any warranty claim.
33. Suggestions and Submissions
We welcome comments, ideas and suggestions regarding Sell Computer Parts. Unless otherwise agreed in writing, feedback submitted to us is not confidential and may be used by Sell Computer Parts without compensation or obligation to you.
34. Compliance With Laws
You are responsible for complying with all laws and regulations applicable to your use of the Services and your transactions with other users.
We may collect, verify, retain or disclose information when reasonably necessary to comply with applicable law, valid legal process, regulatory requirements, fraud prevention obligations or governmental requests.
Users may not use the Services where doing so would violate applicable trade sanctions, export controls or other laws.
35. Taxes
Buyers and Sellers are responsible for determining and satisfying their respective tax obligations arising from marketplace transactions except to the extent applicable law specifically requires Sell Computer Parts or a third-party provider to collect, report or remit a tax.
Sell Computer Parts does not provide tax advice. Users should consult a qualified tax professional concerning their individual obligations.
36. Third-Party Services
The Services may contain links to or integrations with third-party services, including payment processors, shipping providers, manufacturers, warranty providers and other websites or applications.
Your use of third-party services may be governed by separate terms and privacy policies established by those providers.
Sell Computer Parts does not control and is not responsible for the acts, omissions, availability, security, policies or performance of independent third-party services.
37. Marketplace Disputes
Because Buyers and Sellers transact directly with one another, they are primarily responsible for resolving disputes concerning Listed Items, payments, shipping, delivery, condition, specifications, compatibility, authenticity, functionality, returns and refunds.
Sell Computer Parts may, but is not required to, review communications, listings, transaction information or other relevant account activity in connection with a dispute.
Our decision to assist with one dispute does not obligate us to intervene in future disputes.
38. Disclaimer; No Warranty

SELL COMPUTER PARTS DOES NOT WARRANT OR GUARANTEE THE EXISTENCE, QUALITY, SAFETY, LEGALITY, AUTHENTICITY, CONDITION, COMPATIBILITY, PERFORMANCE, RELIABILITY, FUNCTIONALITY OR OWNERSHIP OF ANY LISTED ITEM.
WE DO NOT GUARANTEE THE IDENTITY, RELIABILITY, HONESTY OR PERFORMANCE OF ANY BUYER OR SELLER OR THAT ANY USER WILL COMPLETE A TRANSACTION.
WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, COMPLETE OR ERROR-FREE OR THAT DEFECTS WILL ALWAYS BE CORRECTED.
You acknowledge that used, refurbished and pre-owned computer parts, computers and electronics may contain defects, have limited remaining useful life, lack manufacturer warranties or fail after purchase.
You acknowledge that the installation, modification or use of computer components may result in incompatibility, system instability, data loss or damage to other equipment.
You assume the risks associated with purchasing, selling, installing, testing, modifying, repairing, upgrading or using Listed Items to the fullest extent permitted by law.
39. Installation and Use of Computer Components
Computer components may require technical knowledge for proper installation, configuration, testing and use.
Buyers are responsible for determining whether they possess the necessary knowledge, tools and equipment to safely install or use a Listed Item or whether professional installation should be obtained.
SELL COMPUTER PARTS IS NOT RESPONSIBLE FOR PERSONAL INJURY, PROPERTY DAMAGE, DATA LOSS, SYSTEM FAILURE OR DAMAGE TO OTHER COMPONENTS RESULTING FROM THE INSTALLATION, REMOVAL, TESTING, MODIFICATION, REPAIR OR USE OF A LISTED ITEM.
40. Release
TO THE FULLEST EXTENT PERMITTED BY LAW, IF YOU HAVE A DISPUTE WITH ONE OR MORE USERS, YOU RELEASE SELL COMPUTER PARTS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS FROM CLAIMS, DEMANDS, LIABILITIES, DAMAGES AND LOSSES ARISING OUT OF OR RELATED TO THAT DISPUTE.
41. California Notice
To the extent applicable, California residents acknowledge California Civil Code Section 1542, which addresses claims that may be unknown at the time a general release is executed. To the fullest extent legally permitted, you agree that the release contained in these Terms includes claims that you do not know or suspect to exist at the time of the release.
42. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Sell Computer Parts, its affiliates and their respective officers, directors, employees, contractors, agents, successors and assigns from claims, liabilities, damages, losses, expenses and reasonable attorneys’ fees arising out of or related to:
- Your breach of these Terms.
- Your violation of applicable law.
- Your violation of another person’s rights.
- Your User Content.
- Your Listed Items.
- Your purchase, sale, shipment, delivery, installation, repair, modification or use of a Listed Item.
- Your marketplace transactions.
- Your misuse of the Services.
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification, in which case you agree to reasonably cooperate with our defense.
43. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SELL COMPUTER PARTS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUCCESSORS AND ASSIGNS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES, THESE TERMS OR ANY TRANSACTION BETWEEN USERS.
THIS LIMITATION INCLUDES CLAIMS ARISING FROM LISTED ITEMS, PAYMENTS, SHIPPING, DELIVERY, RETURNS, REFUNDS, USER CONDUCT, HARDWARE FAILURE, DATA LOSS, DATA RECOVERY, COMPATIBILITY PROBLEMS, INSTALLATION, COMPONENT DAMAGE, MANUFACTURER ACTIONS, WARRANTY CLAIMS, PROPERTY DAMAGE OR THIRD-PARTY SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, SELL COMPUTER PARTS’ AGGREGATE LIABILITY TO YOU ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE LESSER OF ONE THOUSAND DOLLARS ($1,000.00) OR THE TOTAL FEES PAID OR PAYABLE TO SELL COMPUTER PARTS IN CONNECTION WITH THE TRANSACTION GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, the limitations above will apply only to the maximum extent permitted by law.
44. Account Suspension and Termination
We may investigate suspected violations of these Terms and may take reasonable action including:
- Removing or restricting listings
- Canceling bids or offers
- Canceling or restricting transactions
- Restricting marketplace features
- Temporarily suspending an account
- Permanently terminating an account
- Withholding access to Seller features while fees remain unpaid
- Cooperating with law enforcement or regulatory authorities when appropriate
Termination of an account does not eliminate obligations relating to completed transactions, outstanding fees, disputes or provisions of these Terms that by their nature survive termination.
45. Service Availability
We may modify, suspend, discontinue or restrict any feature or portion of the Services at any time.
We are not liable for interruptions resulting from maintenance, technical problems, third-party providers, internet disruptions, security incidents, events beyond our reasonable control or other service interruptions.
46. International Availability
Sell Computer Parts does not represent that the Services or every marketplace feature are available or legally permissible in every jurisdiction.
Users accessing the Services outside the United States are responsible for complying with applicable local laws and regulations.
47. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on Sell Computer Parts with a revised effective date.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
If you do not agree with an updated version of these Terms, you should stop using the Services.
48. Governing Law and Venue
These Terms will be governed by and construed in accordance with the laws of the State of Maryland, without regard to conflict-of-law principles.
To the extent permitted by applicable law, you agree that any legal action arising out of or relating to these Terms or the Services will be brought in a court of competent jurisdiction located in Montgomery County, Maryland.
49. General Provisions
Entire Agreement. These Terms, together with the policies and terms incorporated by reference, constitute the agreement between you and Sell Computer Parts concerning the Services.
Severability. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
No Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. Sell Computer Parts may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets or other lawful business transaction.
Headings. Section headings are provided for convenience and do not affect the interpretation of these Terms.
Survival. Provisions that by their nature should survive termination will remain effective after termination, including provisions concerning fees, intellectual property, releases, disclaimers, indemnification, limitation of liability and disputes.
English Language. If these Terms are translated, the English-language version will control to the extent permitted by applicable law in the event of a conflict.
No Legal or Tax Advice. Information provided through Sell Computer Parts is for general informational purposes and does not constitute legal, tax, accounting or other professional advice.

Your use of specific Sell Computer Parts marketplace features may also be governed by additional terms and policies incorporated into these Terms.
If you participate in auctions or place bids, you are also subject to our Bidder Terms.
If you create listings or sell through Sell Computer Parts, you are also subject to our Seller Terms.
